Re: Common sense Wins for once
I am so glad that Asher's Bakery have "won " this , when no lines are drawn because we don't want upset minority groups we could sue the Jewish baker for refusing to ice a swastika cake , the Caribbean baker for refusing a go home cake , this is not about icing a cake , it's about having the fundamental right to not have to do something that offends you

Hi Rob.
Didn't anyone check whether the Sesame Street icing would have affected any copyright , would maybe have cost the baker a lot more. One good thing would have come of it; the baker would get a lot more customers coming {straight] to his shop.
Cheers Des
Re: Common sense Wins for once
The squeaky wheel gets the oil, so the minority get their wish.
The world as we knew it is fast dissapearing as minority groups take over.
Many now afraid to speak out, to refuse service or other incase they end up in court like the baker did.
But it is a sad indictment of society today when we are no longer able to chose what we want or do not want to do.
Re: Common sense Wins for once
That case cost over £500,000
Re: Common sense Wins for once
because some delicate little flower felt offended , I remember when poofs were proper men , not like today's softies , If this case had been lost then the floodgates would be opened , what ever offensive wording you wanted , the bakery would be obliged to ice it , from Heil Hitler to I like small boys , and Stonewall the Gay rights mob must be really hurting , but why did the Equality Commission take this up

And who will end up paying?
Re: Common sense Wins for once
When suing someone,
who ever loses the case has to pay the Court Costs and also the Legal costs of the other side on top of their own legal costs.
A few years ago I had a case against CUNARD, NO WIN NO Fee Lawyers would not take it up.
Cunard wanted to take it to the Admiralty Court in London. Now that would have cost me a Million if I had lost the case.
I went to my local Magistrates Court and for FIXED FEE of £108. it is tried by a local Judge, I didn't have to go to Court, I won the case and was awarded £3,000. If I had lost I would nothing else to pay. What a good Service. not many people know that.
So that is the best way to do it.

Re: Common sense Wins for once
This is where the law screws up , twenty years ago a builder we used at work [ashore ] went bust , the receiver sued for £20,000 because we would not pay the invoice for substandard work , we got a barrister in , to win would cost £25,000 in legal fees ,. to lose at least £60,000 , they had nothing to pay our fees from so we offered and they accepted £10,000 to go away .
Re: Common sense Wins for once
That is why it is better to go to the Local Court for win or lose , only £108.
Re: Common sense Wins for once
There us a £10,000 upper limit though
